These Terms and Conditions govern the relationship between you, the
participant, and us, Southern Visions. By booking a trip, you agree to be
bound by these Terms and Conditions. They outline, among other things, our
cancellation policy and certain limitations of liability. These terms affect
your rights to sue, governing law, forum and jurisdiction; please be sure to
carefully read these terms and make sure you understand your rights and
obligations and our rights and obligations.
Southern Visions is a provider that operates for active travel companies,
therefore, except for direct personal booking to Southern Visions, any
dispute that occurs on a trip will be between the participant and the
booking company. Southern Visions won’t be liable to it.
Southern Visions, its and their employees, shareholders, subsidiaries,
affiliates, officers, directors, successors, agents, representatives, and
assigns (collectively Southern Visions) does not own or operate any entity
which provides, or is to provide, goods or services for your trip including,
for example, lodging facilities, transportation companies, food service
providers, equipment suppliers, babysitters or daycare providers, etc. As a
result, Southern Visions is not liable for any negligent or willful act or
failure to act of any such third person, or of any other third party.
Reservations & Payments
Only for Personal booking : A deposit of 25% per person is required to
secure your reservation. To secure reservations on a trip departing within
60 days, a full payment is required by credit card at the time of booking.
Final payment for all trips must be made in full to SOUTHERN VISIONS at
least 60 days prior to departure. Reservations will be cancelled if final
payment is not received by the due date and cancellation charges will apply.
Tour prices stated are per person and based on double occupancy. For extras,
it will be charged on your invoice. Every effort has been made to produce
pricing information accurately. We reserve the right to correct errors.
Changes in Plans
For any changes you make to your reservation that affect, departure date, or
program extension, a € 100,00 per-person administrative charge applies, in
addition to any cancellation penalties or applicable fees imposed by
vendors, hotels, or cruise lines. For changes made within 60 days of your
original departure date, our cancellation policies apply. All changes are
subject to availability and cannot be guaranteed.
Before the trip, a travel planner will be sent to the participant with all
the information for preparing a good trip like, hotel suggestions before and
after the trip, gear list, general information about the area. Southern
Visions strongly advices the Participants to read it carefully.
Responsibility
Southern Visions reserves the right to correct promotional or pricing errors
at any time, or to increase the program price in the event of cost increases
due to changes in, cruise fares, currency fluctuations, park fee increases,
taxes, or fuel surcharges. Southern Visions reserves the right to decline to
accept or retain any person as a member of any tour or to cancel or alter
the tour without notice, in which event your sole remedy shall be a prorated
refund for any unused portion of the trip. Hotels and other accommodations
are subject to change.
Before starting a trip the Participant has to be covered by its insurance or
any travel insurance he will previously apply for and will sign a release
form for Southern Visions.
The participants are voluntarily on a Southern Visions trip and have the
knowledge of the numerous risks and dangers involved including but not
limited to: negligence in any manner on the part of Southern Visions
including, without limitation, negligence in the conduct or arrangement of
the trip in any respect from inception to completion, negligence with regard
to bicycle selection or maintenance, in the maintenance or operation of any
van or other motor vehicle utilized to transport passengers, etc.; physical
exertion for which the Participant is not prepared; forces of nature;
transportation failures whether by plane, train, auto, boat, canoe, kayak,
bicycle, ski, horseback or other animal, by foot, or by any other
conveyance; consumption of alcoholic beverages; risks associated with food
or impure water; civil unrest; terrorism or the threat thereof; criminal
activity; dangers associated with wild or other animals; breakdown or
failure of bicycles or other equipment; high altitude; accident or illness
without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided;
epidemics or the threat thereof; and stolen, lost, or misplaced luggage or
property. The participants have the acknowledge that the enjoyment and
excitement of adventure travel is derived in part from the inherent risks
incurred by travel and activity beyond the accepted safety of life at home
or work and that these inherent risks contribute to such enjoyment and
excitement, being a reason for my participation. The participants agree to
be responsible for their own welfare and accept any and all risks of delay,
unanticipated events, inconvenience, illness, injury, emotional trauma or
death.
Southern Visions reserves the right to take photographic or film records of
any of its trips and the participants agree that Southern Visions may use
any such photographic or film records for promotional and/or commercial
purposes, as well as approve such use by third parties with whom Southern
Visions may engage in joint marketing, without any remuneration. By signing
a release form, the Participants assign all right, title, and interest he
may have in or to any and all media in which its name or likeness might be
used by Southern Visions.
Southern Visions reserves the right to make route, hotel, itinerary and trip
modifications as required or desirable to improve the trip quality and/or to
accommodate the comfort and well-being of guests. For this reason, the route
can be changed compare to the brochure or the website and Southern Visions
can’t be blamed for it.
Medical Issues
You must advise us in writing, at or prior to booking, of any physical,
emotional or mental condition which may require professional attention
during the trip or may require the use of special equipment. If you fail to
disclose any such conditions, Southern Visions may refuse to allow you to
take the trip and you will forfeit the trip cost; and in such event we shall
have no liability, financial or otherwise.
If you are so challenged, you must bring and be responsible for all
necessary items related to your condition. If any such condition arises
after the trip is booked, you must advise us in writing immediately. Failure
to advise us shall release Southern Visions and all professional personnel
from any liability related to such condition or its treatment.
We cannot accommodate women past their sixth month of pregnancy. We also
cannot accommodate passengers requiring wheelchair assistance, as most
features of Southern Visions trips are not wheelchair-accessible.
Children
Children 9 years or older are welcome on our European tours if accompanied
by an adult.
Health and Fitness
We will send you information on the physical requirements for your trip with
your pre-trip materials. In some cases, you may want to discuss these with
your doctor. Your health and safety during your trip are our first concern,
but Southern Visions is not a medical facility. You should be in good health
to participate in our active vacations. Southern Visions reserves the right
to decline any trip participant whose condition, in our opinion, may affect
the health, safety or enjoyment of other participants. Southern Visions is
not responsible for the costs of any medical treatment you may require
during the trip. Under no circumstances is Southern Visions responsible for
the quality of medical care, or lack thereof, you may receive while on the
trip. We strongly recommend that you obtain medical and dental insurance
that will cover the cost of any medical and dental assistance you may
require during your trip.
Applicable Law
This relationship shall be governed by the laws of Italy. Any claims against
Southern Visions must be brought in the Court of Italy in the region of
Puglia.
Single Travelers
Most programs offer a limited number of single rooms, subject to
availability and hotel space. Please see individual rate charts in this
catalog for costs.
Group Size
All Southern Visions trips and their extensions are limited to no more than
18 participants (with the exception of our boat cruises). All trips and trip
extensions require a minimum number of participants to operate. Southern
Visions reserves the right to change the departure date of any trip, as well
as cancel any trip or optional extension that does not reach a minimum level
of participation.
Passports
All international programs require a valid passport. All information on your
passport including name, passport number and expiration date are needed at
time of booking. Southern Visions is not responsible in any way for your
failure to do so.
What's Included
Your tour price includes lodging, all breakfasts, selected lunches, and
selected dinners (check individual tour itineraries for specifics), Southern
Visions leader service if it’s including in the trip you choose, gratuities
for the inns, taxes, a Southern Visions bike, (a Southern Visions helmet
will be available upon request if you are not bringing yours; in any case an
helmet must be worn all the time on a bicycling trip), cycling maps with
written route directions, and a fully equipped support van.
Gratuities
Gratuities for hotels and the food portion of your tour are paid by Southern
Visions; gratuities for alcoholic drink servers are not. Gratuities for
Southern Visions leaders are always appreciated but are entirely at your
discretion.
Accommodations
Tour prices are based on double occupancy rooms. Solo travelers will be
assigned a roommate of the same gender. Single rooms are available on a
limited basis with a single supplement fee. We may not be able to honor
private room requests during certain peak periods. For late bookings (less
than 60 days prior to departure), solo travelers will be charged a single
supplement fee that will be refunded if a roommate is later assigned. Single
rooms are often smaller than double rooms. Although rooms typically vary in
size, layout and style, private baths are guaranteed every night in Europe.
On all other tours where there is a mix of baths, private baths are assigned
as evenly as possible.
The Southern Visions web site and associated electronic publications are
owned and operated by Southern Visions from Logovia. Except where otherwise
specified the contents of this Web site are subject to intellectual property
rights including copyrights and trademarks held by Logovia, all rights are
reserved. The content of this Web site is provided for informational
purposes only and may include inaccuracies, typographical errors, or change
periodically. All materials are provided as is where is unless explicitly
stated.
Exceptions to this policy cannot be made for any reason, including, but not
limited to, weather, terrorism, civil unrest, personal, family or medical
emergencies. The Participant understands that this is a legally binding and
enforceable contract and accepts it of its own free will. The Participant
agrees that if any portion of this agreement is found to be void or
unenforceable, the remaining portions shall remain in full force and effect.
Cancellation Policies
Cancellation by the client
If you must cancel your trip for any reason whatsoever, the following
cancellation fees are applicable:
• cancellations from 60 to 30 days before departure date: 20% of the tour
cost;
• cancellations from 29 to 15 days before departure date: 40% of the tour
cost;
• cancellations from 14 to 9 days before departure date: 60% of the tour
cost;
• cancellations from 8 to 2 days before departure date: 80% of the tour
cost;
• cancellations within 2 days of intended departure date: 100% of the tour
cost.
To cancel your trip you must notify our office in writing. Note: we highly
recommend contracting sufficient cancellation insurance.
Cancellation by Southern Visions
Southern Visions reserves the right to cancel a (group) tour, in cases where
the necessary minimum number of participants, as is specified on the
website, has not been reached. Participants will be notified of any such
cancellation in writing at least date of departure.
Replacement
If you cannot travel as planned, you have the right to send someone in your
place, provided that Southern Visions is notified within 4 days of the
departure date. Southern Visions can object to the above replacement if the
replacement does not satisfy the requirements for participants. In such case
the cancellation conditions will apply.
The original contract is not affected by replacement, but any resulting
additional costs will be charged to the client. Southern Visions is not
responsible for any possible non-acceptance of the above replacement by any
other organizers or agents involved with the tour.
